As a parent, you want nothing but the best for your child. Unfortunately, you know one thing to be true: Children don’t always make the right decisions.

One of the most common mistakes among teenagers and college students is driving under the influence of alcohol. This may not be the most serious crime, but it’s not something you can sweep under the rug. Instead, you need to learn more about the many ways you can help your child avoid the most serious punishment.

The consequences of a DUI conviction can range from license suspension to a hefty fine. Imprisonment is also a possibility if another crime was committed at the same time.

Defense strategies

There are many defense strategies for fighting a DUI charge, with the following among the most common:

  • Improper stop. This is an argument that the arresting officer did not have probable cause to make the traffic stop.
  • Administration of field sobriety test. A field sobriety test must be administered in the appropriate manner. If this doesn’t happen, the arrest could be improper.
  • Administration of the Breathalyzer test. For example, the officer must be properly trained to administer the test. There could be many factors that impact the outcome of a Breathalyzer test, such as if a person suffered from indigestion or vomiting at the time.
  • Rising blood alcohol concentration. Not the most common defense, this is an argument that the person’s blood alcohol level increased between the traffic stop and administration of the Breathalyzer test.

It’s good to know that your child has many options for fighting his or her drunk driving charge. Even so, there’s more to this than meets the eye. Just because a defense strategy is used doesn’t mean it will result in the case being thrown out.
