What Indiana Law Says

In Indiana, rape can be committed several different ways. According to Indiana Code 35-42-4-1, rape is knowingly or intentionally having sexual intercourse with another person or knowingly or intentionally causing another person to perform or submit to other sexual conduct when:

  • The other person is compelled by force or imminent threat of force
  • The other person is unaware that the sexual intercourse or other sexual conduct is occurring
  • The other person is so mentally disabled or deficient that consent to sexual intercourse or other sexual conduct cannot be given

Criminal penalties for rape allegations vary based on the violence, threat of force, weapons used, other aggravating factors and the age of the victim. Aggravating factors increase penalties because of the serious and malicious nature involved.

Indiana’s age of consent is 16 years old. Indiana also has a Romeo and Juliet Law that permits 14 and 15 year olds to engage in nonforced sexual activity with peers who are no more than 4 years older.
